Welcome to the Lender Compare mobile application, owned and operated by Lender Compare Network LLC (“Company”, “we”, “our”, or “us”). These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you”, “your”, or “User”) and Lender Compare Network LLC regarding your access to and use of the Lender Compare mobile application (“App”) and any services provided through it. Please read these Terms carefully before using our App. By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must discontinue use of the App immediately.

1. Overview of Services

Lender Compare is a financial technology platform designed to provide consumers in the United States with access to loan options of up to $2,500 by connecting them with a network of third-party, independent lenders. We do not offer loans ourselves, nor do we act as a lender, credit provider, or credit counselor. We do not make credit decisions or guarantee loan approval or terms. All loan products and services are solely offered by third-party lenders who operate independently of Lender Compare Network LLC.

Lender Compare – Loan Terms

– APR (Annual Percentage Rate): Rates range from 4.99% to 35%, depending on your credit profile, loan amount, and selected repayment term.
– Repayment Periods: You can choose repayment terms ranging from 90 days (3 months) to 24 months (2 years). This allows you to select a plan that fits your budget and financial goals.
– No Commitment: You’re under no obligation to accept any offer. Review the terms and choose only if it makes sense for you.
– Representative Example: If you borrow $600 and repay it over 12 months with a fixed APR of 10.99%, your estimated monthly payment would be $52.66, resulting in a total repayment amount of approximately $631.90, which includes around $31.90 in interest. This example assumes equal monthly payments and does not account for any additional fees such as origination or late payment charges. Actual terms may vary depending on the lender, your credit profile, and other factors.

2. Eligibility Requirements

To use the App, you must be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is older. You must be a legal resident of the United States and have the legal capacity to enter into binding contracts. You must also provide accurate, truthful, and complete information during the application process. Any falsified information may lead to denial of services and legal consequences. Lender Compare services are not available in all states or jurisdictions, and we reserve the right to restrict access where prohibited by law.

3. User Responsibilities and Obligations

By using this App, you agree to:

• Provide truthful, accurate, current, and complete information about yourself when prompted by our forms or systems.
• Maintain and promptly update your information to keep it accurate and complete.
• Only use the App for lawful purposes, and in a manner consistent with all applicable local, state, and federal laws and regulations.
• Not attempt to gain unauthorized access to any portion of the App, other accounts, or computer systems connected to the App through hacking, password mining, or other illegitimate methods.
• Not interfere or attempt to interfere with the proper functioning of the App or any activities conducted on or through the App.
• Not distribute, post, or transmit any viruses, malware, or other harmful software or data.

4. Loan Matching Process

The App allows you to submit a loan inquiry by filling out an application form. Once submitted, your application will be shared with our lending partners who may offer you loan terms based on their individual underwriting criteria. We do not guarantee that you will receive an offer, nor do we control the terms, interest rates, repayment periods, fees, or approval requirements imposed by the lenders. All decisions regarding your loan are made solely by the third-party lenders.

Loan availability, terms, and conditions may vary depending on your state of residence, credit history, employment status, income level, and other factors determined by the lender. We strongly encourage users to carefully read and understand any loan agreement and disclosures before accepting any loan offer. You are under no obligation to accept a loan offer made through our App.

5. No Financial Advice or Guarantee

Lender Compare Network LLC does not provide legal, financial, credit, tax, or investment advice. The content within the App is provided for informational purposes only and should not be construed as a substitute for professional consultation. Use of our App does not constitute the formation of a client, lender, or fiduciary relationship. You are solely responsible for evaluating any loan offer, the associated risks, and making informed financial decisions.

6. Third-Party Lenders and Websites

Our App may contain links to third-party websites, products, services, or content that are not owned or controlled by Lender Compare Network LLC. These links are provided solely for your convenience. We are not responsible for the content, terms, policies, or practices of any third parties, including lenders or credit bureaus. Accessing and using third-party services is entirely at your own risk, and any transactions, agreements, or disputes are solely between you and the third party.

7. License and Restrictions

Lender Compare Network LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device that you own or control, solely for personal, non-commercial purposes. You may not:

• Modify, copy, reproduce, distribute, sell, or license any portion of the App without our prior written consent.
• Use the App for any purpose that is unlawful or prohibited by these Terms.
• Use any automated system (including bots, spiders, or scripts) to interact with the App.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of any software used to provide the App.

8. Intellectual Property Rights

All content and materials within the App—including but not limited to text, images, graphics, logos, software, user interfaces, and the overall design—are owned or licensed by Lender Compare Network LLC and are protected by copyright, trademark, trade dress, and other applicable laws. You may not use our intellectual property in any way that infringes upon our rights without prior written authorization.

9. Disclaimer of Warranties

THE APP AND ALL ASSOCIATED SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. LENDER COMPARE NETWORK LLC MAKES NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, RELIABILITY, OR AVAILABILITY OF THE APP OR ITS CONTENT. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LENDER COMPARE NETWORK LLC OR ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP OR ANY LOAN SERVICES OBTAINED THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to defend, indemnify, and hold harmless Lender Compare Network LLC, its affiliates, and their respective directors, officers, employees, and agents from and against all claims, actions, damages, obligations, losses, liabilities, and expenses (including reasonable attorney’s fees) arising from: (a) your use of or access to the App; (b) your violation of these Terms; (c) any inaccurate information you provide; or (d) your violation of any third party rights, including intellectual property rights or privacy rights.

12. Modification and Termination

We reserve the right to change, update, suspend, or terminate the App or these Terms at any time, without prior notice. We may also limit or restrict access to some or all features of the App. Continued use of the App following any changes constitutes acceptance of the modified Terms. We also reserve the right to suspend or terminate your access to the App at our sole discretion if we determine that you have violated these Terms, applicable laws, or engaged in misconduct.

13. Governing Law and Arbitration

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the App shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be held in Delaware, unless otherwise agreed in writing. You waive the right to a jury trial and to participate in class actions or class arbitrations.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Lender Compare Network LLC concerning your use of the App. They supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us regarding the App.
